The Minister of Tourism and Andalusia Exterior, Arturo Bernal, has reported on the results achieved after the implementation of Decree 31/2024, which updated the outdated regulations on Tourist Use Housing and the signing of collaboration agreements with Municipalities to ensure compliance with local urban regulations and facilitate the detection of possible infractions.
These measures have started to yield results, with a total of 2,656 cancellation procedures processed in 2024. Out of this total, 1,484 have already been canceled, 718 are in the process of allegations, and 454 are in progress.
In parallel to this work, the Ministry of Tourism and Exterior Action has proposed new control tools, including improvements in the Andalusia Tourism Registry. In this sense, an notification has been launched in the registry for localities where municipalities have set limits on the number of tourist use housing units in their municipal area for reasons of general interest.
This mechanism has been implemented in Seville and will be extended to other municipalities. Therefore, any person attempting to register a property in a declared saturated area will receive an automatic notification informing them that they are in one of these areas, and, if they continue with the procedure, they will be immediately notified of the start of the registration cancellation process, also being subject to the opening of a sanctioning procedure for infringement of tourism regulations, due to the falsehood in their responsible declaration.
On the other hand, through the Development Decree-Law approved by the Government Council, greater legal certainty is provided for the restrictive actions on this type of tourist accommodation that municipalities have carried out in accordance with European regulatory requirements.
The draft Law on Sustainable Tourism also includes measures related to tourist use housing, such as the impossibility of entering the Tourism Registry for one year for those properties that access with falsehood or do not provide their license or responsible declaration, according to the urban regulations that apply to them.
«With these measures, we continue to advance towards a fairer and more effective regulation that allows for a sustainable development of tourism in Andalusia without harming coexistence and quality of life in our municipalities,» the minister assured.
