Order of June 23, 2025, establishing the calendar of Sundays and holidays on which commercial establishments may remain open to the public during the year 2026.

The Autonomous Community of Andalusia, in accordance with the provisions of article 58.1.1.� of the Statute of Autonomy for Andalusia, has exclusive powers in the administrative organization of commercial activity, including the regulation of commercial calendars and schedules, respecting, in its exercise, the constitutional principle of a unified market and the general organization of the economy. These powers must be exercised in accordance with the bases and the organization of general economic action and monetary policy of the State, in accordance with the provisions of articles 38, 131, and 149.1.13 of the Spanish Constitution.
The consolidated text of the Interior Trade Law of Andalusia, approved by Legislative Decree 1/2012, of March 20, following its latest modification by Decree-Law 3/2024, of February 6, which adopts measures to simplify and rationalize administrative procedures to improve citizens’ relations with the Administration of the Junta de Andalucía and promote economic activity in Andalusia, establishes in article 19.1 that the number of Sundays and holidays on which shops may remain open to the public in the Andalusian Autonomous Community shall be sixteen days.
Likewise, the aforementioned article 19, in its sections 2 and 4, states that the annual calendar, setting these days, shall be established, following consultation with the Andalusian Council of Commerce, by order of the competent department in charge of internal trade, which shall be published in the Official Gazette of the Junta de Andalucía before September 1 of the year immediately preceding the year to which it shall apply, and that, in determining these authorized Sundays and holidays of opening, priority should be given to the commercial appeal of the days for consumers, in accordance with the following criteria:
a) The mandatory opening of at least one holiday when two or more consecutive holidays coincide.
b) The opening on Sundays and holidays corresponding to traditional periods of sales or promotional events. It shall be understood that there are two traditional sales periods, the winter sales period, which runs from January 7 to March 7, and the summer sales period, which runs from July 1 to August 31; all this, without prejudice to the provisions of article 25 of Law 7/1996, of January 15, on Retail Trade Organization.
c) The opening on Sundays and holidays with the highest tourist influx in the Autonomous Community, following a report from the competent department in charge of tourism.
d) The opening on Sundays and holidays during the Christmas campaigns, which shall run from the Sunday following the fourth Thursday of November to December 24, and during the Epiphany period, which shall run from December 26 to January 5.
Moreover, article 19.3 of the aforementioned consolidated text provides that Local Corporations, by reasoned agreement of the corresponding body, may exchange up to two of the Sundays and holidays enabled in the regional annual calendar for others based on the commercial needs of their municipal area, in accordance with the criteria established in section 4 of that article.
In general, such exchanges shall be requested from the competent General Directorate in charge of internal trade on the following dates: Before November 1 of the immediately preceding year, those that will take place throughout the following year; before February 1, those that will take place in the second, third, and fourth quarters of the current year; before May 1, those that will take place in the third and fourth quarters of the current year; and before August 1, those that will take place in the fourth quarter of the current year. For the purpose of calculating the deadlines for requesting exchanges, both dates must fall within the periods established above, both the authorized opening day and the day requested for new opening.
Exceptionally, if circumstances arise justifying the renunciation of the exchange requested after its grant, the Municipality may renounce it and, if deemed necessary, request a new exchange by the competent municipal body in accordance with the criteria established in section 4 of article 19, provided that the request is made prior to the date of the exchange granted and, in any case, with one month’s notice of the new requested date.
In no case may exchanges be made for those Sundays or holidays included in any of the cases of open schedule freedom established in article 20. The competent General Directorate in charge of internal trade shall resolve following consultation with the Andalusian Council of Commerce, and the estimated exchanges shall be published in the Official Gazette of the Junta de Andalucía.
In accordance with the foregoing, this order establishes the calendar of Sundays and holidays for authorized commercial opening for the year 2026, applying the legally established criteria, following consultation with the Andalusian Council of Commerce at its regular session on May 29, 2025.
Based on the above, at the proposal of the General Directorate of Commerce and in accordance with article 5 of Presidential Decree 10/2022, of July 25, on the reorganization of Councils and the attributions conferred upon me, using the authorization provided for in article 19.2 of the consolidated text of the Interior Trade Law of Andalusia, approved by Legislative Decree 1/2012, of March 20,
